Understanding Sommer's vacation rental management platform
Platform Definition
Sommer provides a Software-as-a-Service (SaaS) platform designed specifically for vacation rental hosts to manage their property listings, collaborate with team members, and organize their rental business operations. Our platform facilitates property management workflows but does not operate as a booking platform, marketplace, or website builder.
Core Services
Sommer's platform includes the following core functionality:
- Organization creation and management with multi-tenant architecture
- Property listing creation, editing, and status management
- Photo upload and management system via UploadThing integration
- Team collaboration tools with role-based access control
- Amenity management and property specification tools
- User authentication and profile management
- Social features including user following and referral systems
Service Boundaries
Sommer is NOT a booking platform, property marketplace, or website builder. We do not:
- Process guest reservations or bookings
- Handle guest payments or financial transactions
- Provide guest-facing property search functionality
- Create public websites for vacation rental properties
- Operate as a property marketplace or listing service
Account creation, management, and user responsibilities
Account Creation Requirements
To use Sommer's platform, you must create an account by providing accurate and complete information. Account creation requires:
- Valid email address for verification and communication
- Accurate personal information for profile creation
- Acceptance of these Terms of Service and our Privacy Policy
- Compliance with age requirements (18 years or older)
We support email-based authentication with magic links and social login options through Google and GitHub. You are responsible for maintaining the confidentiality of your account credentials.
Platform User Roles
Sommer operates with the following platform-level user roles:
- GUEST: Users with 0 organization memberships, primarily for exploring the platform
- HOST: Users who can own 0-1 organizations, designed for individual property owners
- AGENCY: Users who can create and manage multiple organizations
- TEAMLEAD: Users with team creation capabilities (future functionality)
- SOMMER_SUPERADMIN: Sommer company administrators with full platform access
Account Security and Termination
You are responsible for:
- Maintaining the security of your account credentials
- Promptly notifying us of any unauthorized access
- Using the platform in compliance with these terms
- Ensuring all information provided remains accurate and up-to-date
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose security risks to the platform.
Rules for creating and managing organizations within Sommer
Organization Creation and Ownership
Organizations represent vacation rental business entities within Sommer. Organization creation rules:
- HOST users may own a maximum of one (1) organization
- AGENCY users may create and own multiple organizations
- Organization owners (ORG_OWNER) have full control over their organization
- Organizations provide data isolation in our multi-tenant architecture
Member Management and Roles
Each organization supports the following member roles with specific permissions:
- ORG_OWNER: Full organizational control, billing management, member management, and deletion rights
- ORG_ADMIN: Organization settings management and member invitation capabilities
- ORG_MEMBER: Property management and operational access within the organization
- ORG_GUEST: Read-only access to organization data and properties
Data Ownership and Access
Organization data ownership and access principles:
- All data within an organization belongs to that organization
- Organization members can only access data for organizations they belong to
- Data isolation is maintained between different organizations
- Member removal results in immediate loss of access to organization data
- Organization owners retain control over all data export and deletion decisions
Rules governing property data, photos, and content creation
Property Data Ownership
Property listings created within organizations remain under the control of the organization owner. This includes property specifications, descriptions, pricing information, and associated metadata.
Content Standards and Moderation
All content uploaded to Sommer must meet our content standards:
- Property descriptions must be accurate and truthful
- Content must not violate any laws or regulations
- No discriminatory, offensive, or inappropriate content
- No copyright infringement or unauthorized use of intellectual property
- Professional and respectful communication in all platform interactions
Sommer reserves the right to review, moderate, and remove content that violates these standards.
Photo Management and Rights
Photos uploaded through our UploadThing integration are subject to the following terms:
- You retain ownership rights to all uploaded photos
- You grant Sommer a limited license to store, display, and process photos for platform functionality
- Photo file size and format restrictions apply as specified in the platform
- You are responsible for ensuring you have rights to upload and use all photos
- Photos must comply with our content standards and applicable laws
Guidelines for multi-user collaboration within organizations
Member Invitation Process
Organization administrators and owners may invite team members subject to these requirements:
- Invitations must be sent to valid email addresses
- Invited users must accept terms of service upon joining
- Appropriate roles must be assigned based on responsibilities
- Organization limits on member count may apply based on subscription plan
Access Permissions and Data Security
Access control within organizations follows the principle of least privilege:
- Members can only access data within organizations they belong to
- Role-based permissions determine what actions members can perform
- Administrative functions are restricted to appropriate roles
- Member access can be revoked immediately by organization administrators
Professional Collaboration Standards
All team collaboration must maintain professional standards:
- Respectful and professional communication between team members
- Responsible use of shared organization data and resources
- Compliance with organization policies and procedures
- Appropriate use of collaboration features for business purposes only
Payment obligations and subscription policies (when implemented)
Subscription Plans and Billing
When implemented, Sommer will offer various subscription tiers with different features and limitations:
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as specifically provided in our refund policy
- Subscription plan changes take effect at the next billing cycle
- Organization limits and feature access depend on subscription tier
Payment Processing and Security
Payment processing will be handled through Stripe, subject to their terms of service and PCI compliance standards:
- All payment data is processed securely through Stripe
- We do not store sensitive payment information on our servers
- Failed payments may result in service suspension after grace period
- Payment disputes should be directed to our billing support team
Refund Policy
Limited refunds may be available under specific circumstances:
- Refunds for service interruptions exceeding our uptime commitments
- Pro-rated refunds for subscription downgrades (credit applied to next billing cycle)
- Refunds for billing errors or unauthorized charges
- No refunds for voluntary account termination or plan changes
Ownership and licensing of software, content, and user data
Sommer Intellectual Property
Sommer retains all rights, title, and interest in:
- The Sommer platform software and technology
- Sommer trademarks, logos, and branding materials
- Platform documentation and user interfaces
- Proprietary algorithms and business processes
- All improvements and modifications to the platform
User Content Rights
You retain ownership of all content you create and upload to Sommer, including:
- Property descriptions and listing information
- Photos and media files uploaded to the platform
- Organization profiles and branding materials
- User-generated content and communications
License Grants
By using Sommer, you grant us a limited, non-exclusive license to:
- Store, process, and display your content for platform functionality
- Create backups and ensure data redundancy for service reliability
- Analyze usage patterns for platform improvements (in anonymized form)
- Comply with legal requirements and law enforcement requests
This license terminates when you delete content or terminate your account, subject to reasonable data retention periods.
Privacy practices and data protection commitments
Data protection and privacy are governed by our comprehensive Privacy Policy, which details our data collection, processing, and protection practices in compliance with GDPR, CCPA, and other applicable laws.
How legal disputes are handled and which laws apply
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Dispute Resolution Process
Most disputes can be resolved through our customer support process. For legal disputes that cannot be resolved informally, both parties agree to binding arbitration as the exclusive means of dispute resolution.
How we update these terms and notify users of changes
We may update these Terms of Service periodically to reflect changes in our services, legal requirements, or business practices. We will notify users of material changes through email and platform notifications at least 30 days before the effective date.
Continued use of the platform after the effective date of updated terms constitutes acceptance of the new terms.
